Most people are aware of why they should have a Will, but might not consider granting a Power of Attorney.
A Power of Attorney is a document that enables a trusted relative or friend to step into your shoes in the event of you becoming incapable of handling your affairs personally.
It is a completely separate document from a Will and considering whether or not to grant one requires careful thought and advice. The signing of a Power of Attorney does not immediately change anything. It can lie dormant only to be used if required. However it can only be granted when one has the capacity to understand what is being done.
After capacity is lost a Power of Attorney cannot be granted and intervention by the Courts is usually required which can be time consuming and expensive. A properly prepared Power of Attorney can be a godsend in the event of sudden onset of incapacity and can spare loved ones considerable anguish and inconvenience.
