Where an individual is incapable of granting a power of attorney, Taylor & Henderson may instead be able to put in place a guardianship order. Without this, it may be difficult to make decisions around the individual's property, care or finances.
We are well aware that the decision to apply for a guardianship order is not an easy one. At Taylor & Henderson we will do our utmost to support you during what can be a difficult and distressing time.
A guardianship order will allow you to make decisions on behalf of the incapacitated adult. The court process can be lengthy and it can take around 6 months from start to finish. In this time we will have to instruct a report from a GP, a Consultant and the Mental Health Team at the local authority. Throughout your application our solicitors will keep you up to date and will be on hand to answer any questions you may have.
It may be that Advice and Assistance and/or Legal Aid will be available to help cover some of the costs involved in applying for guardianship.
